Winslow v. School Board of Alachua County, ___ So. 3d ___, 35 Fla. L. Weekly D2284 (Fla. 1st DCA 10/15/10)

The mother sought to recover damages from the School Board for the injuries sustained by her daughter, who was struck by a motor vehicle when she walked into traffic at a school bus stop. The trial court dismissed the mother’s second amended complaint with prejudice, and the appellate court affirmed. “Because the School Board did not have control over this student at the time of the accident, the School Board had no duty to the student.”
